Civil disputes in Ontario may be resolved through any of several processes, such as mediation, arbitration, litigation or tribunal proceedings.

While some processes allow for a speedier resolution and others, though slower, are more appropriate to the needs of the case, all of them share a common characteristic: every party, whether plaintiff, defendant, applicant or respondent, wants the best possible result at the least possible cost.

DSFM's Litigation + Dispute Resolution lawyers will work with you to strike that balance by thoroughly analysing the issues, counselling you on the most cost-effective strategy for every phase of the process, skillfully challenging your opponent's evidence, and otherwise expressing your position with argumentative force and clarity.

Michael Spears is the leader of our Litigation + Dispute Resolution team. He is DSFM's senior litigation partner and has been certified by the Law Society of Upper Canada as a Specialist in Civil Litigation since 1994.

Condominium Litigation + Dispute Resolution

In some disputes between a condominium corporation and a developer, an owner, or a neighbour, such as those relating to the developer's turnover of documents, or to an owner's compliance with the declaration, by-laws or rules, the value of a result can be intangible and difficult to quantify.  In others, such as a first-year deficit claim or a shared costs dispute under a reciprocal or shared facilities agreement, the value is easier to measure.

Our Litigation + Dispute Resolution team works with condominium clients to identify the tangible and intangible elements of a successful result, and to build an optimal strategy for attaining them.  We then guide condominium clients through the dispute resolution process, whether mediation, arbitration, or if necessary, litigation, from start to finish.
